Acturis Portal User Terms


Advisory Insurance Brokers Limited provides access to insurance policy and ancillary documentation through the Towergate Customer Service Portal which can be accessed through a PC and other devices and which is provided using third party software. These User Terms have legal effect between you and Towergate, no matter how you access the Towergate Customer Service Portal. Please read them carefully before using the Towergate Customer Service Portal. By accessing and using the Towergate Customer Service Portal, you agree to comply with and be bound by these User Terms, and agree that you have read and understood them and the documents they refer to. If you do not agree with these User Terms, you must not access or use the Towergate Customer Service Portal.

  1. Interaction with Terms of Business Agreement: These User Terms are separate to, and do not supersede, the terms of business agreed between you and Towergate and which govern the provision of insurance mediation services by Towergate to you. In the event of conflict between these User Terms and such terms of business, the terms of business shall prevail.
  2. Licence: Towergate grants you a non-exclusive, non-transferable license to use any materials while they remain on the Towergate Customer Service Portal.
  3. Use by you: you may, in the ordinary course of your or your organisation’s business and for your internal purposes only (a) view and use the material on the Towergate Customer Service Portal; and (b) download, print, store and/or distribute the material on the Towergate Customer Service Portal.
    You may not (a) work around any of the technical limitations of the Towergate Customer Service Portal or enable disabled or prohibited functionality, (b) reverse engineer or attempt to reverse engineer the Towergate Customer Service Portal or (c) perform or attempt to perform any actions that would interfere with the normal operation of the Towergate Customer Service Portal.
  4. Disclaimer: All warranties, conditions and other terms implied by statute or common law are excluded to the maximum extent permitted by applicable laws. To the maximum extent permitted by applicable law, in no event shall Towergate be liable for any direct, indirect, punitive, incidental, special, consequential damages, or any other damages whatsoever, including without limitation, damages for loss of use, data or profits, arising out of or in any way connected with your use or the performance of the Towergate Customer Service portal, with the delay or inability to use the Towergate Customer Service portal, whether based in contract, tort, strict liability or otherwise.
  5. No advice: The information and documents provided on or through the Towergate Customer Service Portal is provided for information purposes only and does not constitute advice. Any advice in connection with your insurance arrangements will be provided to you by Towergate by means of separate communications and shall be governed by the separate terms of business agreement between you and Towergate.
  6. Service availability: Towergate will use its best efforts to provide 24 hour daily access to the Towergate Customer Service Portal. However, Towergate makes no representation or warranty that 24 hour service will be available. You agree and acknowledge that the Towergate Customer Service portal will, at times, be unavailable due to regularly scheduled maintenance, service upgrades, or other mechanical or electronic failures. Towergate shall not be responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to the Towergate Customer Service Portal.
  7. User password and security: Using the Towergate Customer Service Portal requires the use of a user name and password. The confidentiality of the user name, password and account itself are the responsibility of the user. Any activities that occur under users’ accounts are their responsibility. You agree to notify Towergate immediately of any unauthorised use of accounts or any other breach of security. The use of another person’s username and password is expressly prohibited. Towergate is not liable for any harm related to the misuse or theft of usernames or passwords, disclosure of usernames or passwords, or your authorisation to allow another person or entity to access and use the Towergate Customer Service Portal using your username or password.
  8. Confidentiality and intellectual property rights: some content and materials accessible via the Towergate Customer Service Portal may be confidential to your organisation.
  9. Your breach: in its sole discretion, Towergate may remove content and/or suspend your user account and access to the Towergate Customer Service Portal if it believes you are using or have used the Towergate Customer Service Portal in breach of these User Terms.
  10. Privacy and cookies: privacy is important to Towergate. You agree and understand that Towergate may process your personal information in accordance with the Towergate Fair Processing Notice. Towergate uses cookies on its site in accordance with the Towergate Fair Processing Notice.
  11. Changes to these User Terms: Towergate may post changes to these User Terms via the Towergate Customer Service Portal, and such changes shall be effective from the next time you use the Towergate Customer Service Portal.
  12. Governing law: these terms are governed by English law.
